The defendant was a practitioner of the firm in which the plaintiff acted as manager. Not having appeared to render an account, and having later confessed to appropriating the firm's money, the defendant after the investigation sent a letter to the company's headquarters stating that the money was borrowed at the behest of the plaintiff, who would also have kept part of the value.

O querelado era pracista da firma em que atuava o querelante como gerente. Não tendo comparecido para prestar conta, e tendo depois confessado se apropriar do dinheiro da firma, o querelado após a investigação enviou uma carta a sede da empresa afirmando que o dinheiro foi emprestado a mando do querelante, que teria também ficado com parte do valor.
