O réu estaria fumando próximo de um botequim localizado nas proximidades da Recebedoria de Rendas do Estado quando aproximou-se dele os soldados da Policia Militar do Estado Alfredo Baião Ribas e Antônio Marques Côrrea. Os militares deram voz de prisão ao acusado por terem identificado um cheiro estranho da fumaça do cigarro que o réu portavam. As citadas autoridades apanharam das mãos do indicado uma bagana que identificaram ser de um cigarro de maconha. Contudo, o acusado não obedeceua voz de prisão e saiu correndo até ter sido apanhado proximo à Praça do Relógio. Durante o trajeto a Repartição o acusado tentou subornar os militares para que o soltassem. O soldado Alfredo B. Ribas apreendeu a importância e entregou ao Cabo da Guarda. O processo foi prescrito.
