Réu e vítima mantinham relações de namoro, tendo ele se aproveitado de uma ocasião onde ficou sozinho com a menor na casa dela para seduzi-la com promessas de casamento. Ao final do processo, a denúncia foi julgada como procedente e um mandado de prisão foi expedido contra o réu. No entanto, o réu foi libertado do cárcere por ter contraído matrimônio com a vítima.
