O crime ocorreu em meio a um interrogatório, depois que o réu foi detido ao realizar uma desordem em um bar de nome Cristal, em meio ao interrogatório o réu se portou de forma insolente e desrespeitosa e chegou a proferir termos ofensivos à vítima . Ao final do processo ocorreu a prescrição do crime e com isso a improcedência da denuncia.
