The series Criminal Complaint for Defamation, Slander and Libel in Print refers to a set of complaints relating to articles 138, 139 and 140 of the 1940 Penal Code, which refer to the crime of slander, defamation and libel respectively, included in Chapter V, ‘Crimes against honour”, as well as the Law 23.776, the so-called ‘Press Law’. The series preserves the original organisation of the Archives of the Pará Court of Justice. The crime of slander is defined in article 138 as ‘To slander someone, falsely imputing to them a fact defined as a crime’, defamation in article 139 as ‘To defame someone, imputing to them a fact offensive to their reputation’ and libel in article 140 as ‘To revile someone, offending their dignity or decorum’. The cases are criminal complaints, private criminal action cases, i.e. where the initiative lies with the offended party themselves and not the Public Prosecutor's Office, which files public criminal action complaints, in the public interest and not private, according to the 1941 Code of Criminal Procedure.
A série Queixa Crime - Difamação, Calúnia e Injúrias Impressas refere-se a um conjunto de queixas referentes aos artigos 138, 139 e 140 do Código Penal de 1940, referentes ao crime de calúnia, difamação e injúria respectivamente, incluidos no Capítulo V, “Dos crimes contra a honra”, bem como da Lei 23.776, a chamada “Lei da Imprensa”. A série conserva a organização original do Arquivo do Tribunal de Justiça do Pará. O crime de calúnia é definido no artigo 138 como “Caluniar alguém, imputando-lhe falsamente fato definido como crime”, difamação no artigo 139 como “Difamar alguém, imputando-lhe fato ofensivo à sua reputação” e injúria no artigo 140 como “Injuriar alguém, ofendendo-lhe a dignidade ou o decoro”. Os autos são queixas-crime. Estas são processos de ação penal privada, isto é, em que a iniciativa é da própria parte ofendida e não do Ministério Público, que apresenta denúncias de ação penal pública, de interesse público e não particular, segundo o Código de Processo Penal de 1941.
