The Defamation and Slander in Print series, housed at the Amazon Memory Centre and respecting the original organisation of the archive of the Pará State Court of Justice, contains the majority of slander in print cases brought against Pará newspapers, based on Law No. 2,083 of 12 November 1953, the ‘Press Law’ in the case files, which regulates freedom of the press. Article 9 of this law establishes abuses in the exercise of press freedom. In it, letters ‘f’, ‘g’ and ‘h’ refer, respectively, to slander, defamation and libel. Criminal action, according to article 29, could only be brought against these three offences by complaint or denunciation by the Public Prosecutor's Office (when the offended party was a public body or entity). Chapter V of the 1940 Penal Code, ‘Crimes against honour’, defines the crime of slander as ‘To slander someone by falsely imputing to them a fact defined as a crime’ (Article 138). The same chapter includes the crimes of defamation (Article 139: ‘Defaming someone by imputing to them a fact that offends their reputation’) and libel (Article 140: ‘Injuring someone by offending their dignity or decorum’).
A série Difamação e Calúnia Impressa, salvaguardada no Centro de Memória da Amazônia e respeitando a organização original do acervo do Arquivo do Tribunal de Justiça do Estado do Pará, contém em sua maioria, processos de calúnia impressa movidos contra jornais paraense, fundamentados na Lei Nº 2.083, de 12 de novembro de 1953, a “Lei de Imprensa” nos autos, que regula a liberdade de imprensa. O artigo 9 desta lei estabelece os abusos no exercício da liberdade de imprensa. Nesse, as letras “f”, “g” e “h” referem-se, respectivamente, à calúnia, difamação e injúria. A ação penal, segundo o artigo 29, só seria movida contra esses 3 crimes, por queixa ou denúncia do Ministério Público (quando o ofendido for órgão ou entidade pública). O Capítulo V do Código Penal de 1940, “Dos crimes contra a honra”, define o crime de calúnia como “Caluniar alguém, imputando-lhe falsamente fato definido como crime” (Artigo 138). No mesmo capítulo, inserem-se os crimes de difamação (Artigo 139: “Difamar alguém, imputando-lhe fato ofensivo à sua reputação”) e injúria (Artigo 140: “Injuriar alguém, ofendendo-lhe a dignidade ou o decoro”).
