The Active and Passive Corruption series are crimes described in the Brazilian Penal Code of 1940. Active Corruption according to article 333, as ‘offering or promising an undue advantage to a public official, in order to determine him to perform, omit or delay an act of office’. Passive corruption, according to article 317, is the act of ‘requesting or receiving, for oneself or others, directly or indirectly, even when out of office or before assuming it, but because of it, an undue advantage, or accepting a promise of such an advantage’.
A série Corrupção Ativa e Passiva são crimes descritos no Código Penal brasileiro de 1940. Corrupção Ativa segundo o artigo 333, como “oferecer ou prometer vantagem indevida a funcionário público, para determiná-lo a praticar, omitir ou retardar ato de ofício”. Enquanto a corrupção passiva segundo o artigo 317, como o ato de “solicitar ou receber, para si ou para outrem, direta ou indiretamente, ainda que fora da função ou antes de assumi-la, mas em razão dela, vantagem indevida, ou aceitar promessa de tal vantagem”.
