Bigamy or polygamy as a crime was already present in Brazilian legal culture since the Criminal Code of 1830, in article 249: ‘Contracting marriage a second time, or more, without the first one having been dissolved’ of Chapter 3, ‘Crimes against the security of marital and domestic status’. In the Penal Code of 1890, the crime of polygamy remained basically the same, in article 283: ‘Contracting marriage more than once, without the previous one having been dissolved by a judgement of nullity, or by the death of the other spouse’, of Title IX: ‘Crimes against the security of the civil state’, Chapter V: ‘Public outrage against modesty’. Finally, in the 1940 Penal Code, Bigamy is covered by article 235: ‘Contracting a new marriage with someone who is married’, Title VII: ‘Crimes against the family’, Chapter I: ‘Crimes against marriage’. The files below contain cases involving both Brazilians and foreign immigrants. Of the Brazilians, the marriages involved involved travelling between different regions of Pará and Brazil.
A Bigamia ou Poligamia enquanto crime já estava presente na cultura jurídica brasileira desde o Código Criminal de 1830, no artigo 249: “Contrair matrimonio segunda, ou mais vezes, sem se ter dissolvido o primeiro”, do Capítulo 3, “Dos crimes contra a segurança do estado civil, e doméstico”. No Código Penal de 1890, o crime de Poligamia permanece basicamente o mesmo, em seu artigo 283: “Contrair casamento, mais de uma vez, sem estar o anterior dissolvido por sentença de nulidade, ou por morte do outro cônjuge”, do Título IX: “Dos crimes contra a segurança do estado civil”, Capítulo V: “Do ultraje público ao pudor”. Por fim, no Código Penal de 1940, a Bigamia é enquadrada no artigo 235: “Contrair alguém, sendo casado, novo casamento”, Título VII: “Dos crimes contra a família”, Capítulo I: “Dos crimes contra o casamento”. Os processos abaixo contêm tanto casos envolvendo brasileiros como imigrantes estrangeiros. Dos brasileiros, os deslocamentos entre diferentes regiões do Pará e do Brasil são comuns, envolvendo os matrimônios.
