The crime of Threatening has been in Brazilian legal culture since the 1830 Criminal Code of the Empire of Brazil. In this initial legal instrument, it is defined in article 207 as: ‘Promising, or protesting to do harm to someone by means of threats, that is, by word, or in writing, or by any other means’. The offence of ‘threatening’ was one of those that affected individual security. With the establishment of the Republic in 1889, the crime of ‘Threats’ was initially defined as: ‘Promising or protesting, in writing or anonymously, or verbally, to do someone an evil that constitutes a crime, whether or not imposing any condition or order’. It was included in article 184, in Chapter II, ‘Crimes against personal liberty’. With the advent of the new Penal Code of 1940, ‘Threat’ was defined in article 147 of Chapter VI, ‘Crimes against personal freedom’, Section I: ‘Threatening someone, by word, writing or gesture, or any other symbolic means, to cause them unjust and serious harm’, with a penalty of one to six months, or a fine.
O crime de Ameaça encontra-se na cultura jurídica brasileira desde o Código Criminal de 1830 do Império do Brasil. Neste instrumento legal inicial ele está definido no artigo 207 como: “Prometer, ou protestar fazer mal á alguém por meio de ameaças, ou seja, de palavra, ou por escrito, ou por outro qualquer modo”. O crime de “Ameaça” fazia parte daqueles que incidiam contra a segurança individual. Com a República instaurada em 1889, inicialmente o crime de “Ameaças” foi definido como: “Prometer, ou protestar, por escrito assignado, ou anônimo, ou verbalmente, fazer a alguém um mal que constitua crime, impondo, ou não, qualquer condição ou ordem”. Estava presente no artigo 184, no Capítulo II, “Dos crimes contra a liberdade pessoal”. Com o advento do novo Código Penal de 1940, a “Ameaça” foi definida no artigo 147 do Capítulo VI, “Dos crimes contra a liberdade individual”, Seção I: “Ameaçar alguém, por palavra, escrito ou gesto, ou qualquer outro meio simbólico, de causar-lhe mal injusto e grave”, com pena de um a seis meses, ou multa.
